Final Election By-Laws & Rules.

These rules are intended to provide a fair, transparent, peaceful and uniform procedure for the conduct of the PGSHS Welfare Society Election 2026–2027, subject to the Society's valid constitutional documents and applicable law.

Schedule

1. Election Schedule

The election shall be conducted according to the official schedule announced by the Election Commission.

  • Voter-list correction deadline: 20 July 2026.
  • Final Voter List: 22 July 2026.
  • Nomination/document submission: 1 August 2026 to 4 August 2026, during the announced hours.
  • Scrutiny/objections: up to 6 August 2026.
  • Withdrawal: 8 August 2026.
  • Final Candidate List: 9 August 2026.
  • Campaign deadline: 15 August 2026.
  • Polling: 16 August 2026, from 12:00 noon to 7:00 PM.

2. Election Authority

The Election Commission shall supervise and conduct the election impartially.

  • It shall receive and scrutinize nominations, verify eligibility, manage the voter and candidate lists, conduct polling, supervise counting, declare results and decide written election objections.
  • The Election Commission shall not favour any candidate, panel or group and shall apply the same rules to all candidates.

3. Eligibility of Candidates

A candidate must be a registered member/resident of PGSHS Welfare Society; be 30 years of age or above on the applicable nomination date; satisfy the ownership/residency requirement; submit all required documents within time; comply with the Election Code of Conduct; and contest only one position.

  • The candidate shall be of good character and shall not knowingly have engaged in unlawful, fraudulent, violent, threatening, intimidating or other conduct materially prejudicial to the integrity, security or reputation of the Society.
  • Any criminal allegation shall not by itself be treated as proof of guilt; where a legal disqualification is relied upon, it shall be determined according to applicable law.

4. Educational Qualification

President: minimum Graduation/Bachelor's degree or equivalent qualification from a recognized institution.

  • General Secretary: minimum Graduation/Bachelor's degree or equivalent qualification from a recognized institution.
  • Other positions: the qualification, if any, shall be as stated in the approved nomination form/election schedule.
  • Where educational qualification is required, the candidate must submit a copy of the relevant educational certificate/degree with the nomination papers.

5. Proof of Ownership and Residency

Every candidate shall provide a CNIC copy and documentary proof establishing ownership/residency in the Society, including the relevant ownership letter or other document recognized by the Society/competent authority.

  • The Election Commission may seek clarification or additional documentary evidence where ownership or residency is reasonably disputed.

6. Voter Eligibility

Only a registered member whose name appears on the Final Voter List and who is both the bona fide owner and resident/occupant of a house/property within PGSHS Welfare Society shall be entitled to vote.

  • Tenants, caretakers, employees or temporary occupants shall not vote unless they are independently recognized as voting members under the Society's valid constitutional documents.
  • Voting shall be personal. Proxy voting shall not be permitted unless expressly authorized by the Society's valid constitutional framework.
  • Where a property is jointly owned, voting entitlement shall be determined according to the Society's membership records and the applicable approved rules; the Election Commission shall apply the same rule uniformly.

7. Final Voter List

The Final Voter List issued by the Election Commission shall be conclusive for Election 2026–2027.

  • After issuance, no addition, deletion or alteration of voter eligibility shall be permitted except correction of a genuine clerical/typographical/data-entry error or where correction is required by applicable law.
  • A correction shall not be used to introduce a new voter who was not eligible for inclusion during the prescribed voter-list process.

8. Nomination Papers and Deadline

Nomination papers shall be submitted in the prescribed form within the officially announced date and time.

  • All required documents must accompany the nomination submission.
  • No nomination form, supporting document, educational certificate, ownership document, CNIC copy or other mandatory document shall be entertained after the prescribed nomination/document-submission deadline.
  • The Election Commission shall not selectively extend the deadline for an individual candidate. Any lawful change to the schedule must be publicly announced and applied uniformly.

9. Scrutiny

The Election Commission shall verify age, voter-list status, CNIC, membership/residency, ownership, educational qualification where applicable, required declarations and supporting documents.

  • A nomination may be rejected where eligibility is not established or required documents were not submitted within the prescribed period.
  • False, forged or materially misleading documents/declarations may result in rejection or further action in accordance with applicable law and the Society's valid rules.

10. Withdrawal and Replacement of Candidate

Withdrawal Before Nomination Deadline: Any candidate wishing to withdraw shall do so before expiry of the prescribed deadline for submission of nomination documents.

  • Personal Appearance: The candidate must personally appear before the Election Commission and submit a written and signed withdrawal application. No other person, representative, proposer, seconder, panel member or family member may withdraw a candidature on the candidate's behalf.
  • Personal Decision: Withdrawal must be the candidate's own voluntary decision. The Election Commission shall verify the candidate's identity before accepting it.
  • Replacement Before Nomination Deadline: Any replacement of a candidate shall be completed before expiry of the nomination/document-submission deadline. The replacement candidate must submit the complete prescribed documents and satisfy all eligibility requirements within the deadline.
  • No New Replacement After Deadline: After expiry of the nomination/document-submission deadline, no new candidate shall be introduced or entertained as a replacement.
  • Covering/Alternate Candidate: If a duly declared Covering/Alternate Candidate was submitted with the original nomination, that covering candidate may be considered for replacement after the deadline where the original candidate withdraws or becomes ineligible, subject to verification and approval by the Election Commission.
  • No Covering Candidate = No Replacement: Where no Covering/Alternate Candidate was submitted and declared with the original nomination, no replacement candidate shall be entertained after the deadline.
  • Covering Candidate Eligibility: The covering candidate must satisfy all eligibility requirements and submit the prescribed supporting documents at the time of the original nomination. A covering candidate cannot nominate another person in his/her place after the deadline.
  • No Oral/Informal Withdrawal: A telephone call, WhatsApp message, text message or statement by another person shall not constitute a valid withdrawal.
  • Every accepted withdrawal shall be recorded by the Election Commission and the candidate shall sign the official withdrawal record.

11. Character and Code of Conduct

Candidates shall maintain dignity, good conduct and respect for all residents.

  • No candidate shall engage in violence, threats, intimidation, harassment, bribery, vote buying, financial inducement, forged documents, deliberate misinformation, abusive/hate-based language, defamation, damage to election/Society property or interference with polling staff.
  • No candidate shall misuse Society funds, property, official position or confidential information for personal election benefit.
  • Candidates shall campaign only during the announced campaign period and shall respect the rights and campaigns of other candidates.

12. Personal Interest and Conflict of Interest

Every candidate and elected office-bearer shall act in the best interest of PGSHS Welfare Society and its residents.

  • No office-bearer shall use office for personal financial gain, favour relatives/friends, obtain an improper benefit, misuse Society resources or take decisions for personal revenge or private interest.
  • Any actual or potential conflict of interest shall be disclosed, and the concerned office-bearer shall abstain from the relevant decision where appropriate.

13. Panels

Candidates may contest individually or as part of a panel, subject to the approved election procedure.

  • A panel has no authority beyond that legally/constitutionally assigned to its individual elected office-bearers.
  • Each elected office-bearer remains individually accountable to the Society.

14. Polling

Polling shall take place on 16 August 2026 from 12:00 noon to 7:00 PM at the announced polling venue.

  • Only voters whose names appear on the Final Voter List shall be permitted to vote.
  • Original CNIC or approved identification may be required for identity verification.
  • Each eligible voter shall cast votes personally and only in the manner prescribed on the ballot paper.

15. Ballot Papers and Ballot Custody

The ballot paper shall be prepared and approved by the Election Commission.

  • Ballots shall clearly identify the positions and candidates/panels and shall be issued only to verified voters.
  • Ballot papers shall remain under the custody and control of authorized polling officials.
  • A ballot on which the voter's intention cannot reasonably be determined may be declared invalid by the authorized election officials.

16. Counting of Votes

Counting shall be conducted under the supervision of the Election Commission after polling closes.

  • Candidates or their authorized representatives may observe counting subject to orderly conduct and the directions of the Election Commission.
  • The vote count shall be recorded and signed by authorized election officials.
  • In case of a tie, the Election Commission shall apply the tie-breaking method announced before polling.

17. Declaration of Results

The Election Commission shall verify the count and formally declare the successful candidates.

  • The result shall be documented and preserved as part of the election record.
  • Elected office-bearers shall assume office according to the approved transition procedure.

18. Objections and Complaints

Any eligible resident or candidate with a genuine election-related objection may submit a written application to the Election Commission at the designated office during the announced hours.

  • The written objection should state the complainant's identity, issue, facts, person/candidate concerned and supporting evidence, if available.
  • Verbal complaints, telephone calls or social-media allegations shall not constitute a formal election objection unless submitted in writing.
  • The Election Commission shall consider objections impartially and may seek clarification/evidence before recording its decision.

19. Confidentiality and Election Records

CNIC details, contact information, ownership documents, educational documents and other personal information submitted for election purposes shall be kept confidential and used only for legitimate Society/election purposes.

  • Election records shall be preserved securely for the period determined by the Society's valid rules or applicable law.

20. Disqualification / Misconduct

A candidate may be disqualified where the Election Commission establishes ineligibility, material false information, forged documents, bribery, serious threats/violence, serious violation of the Code of Conduct, or deliberate interference with the election process.

  • The candidate shall, where practicable, be given an opportunity to respond before a final adverse decision is recorded.
  • Any action shall remain subject to applicable law and the Society's valid constitutional documents.

21. Governing/Supervisory Body and Elected Union

The Society's General Body/Residential Members are the ultimate membership body within the Society's valid constitutional framework.

  • The Governing/Supervisory Body, where constituted, shall perform constitutional oversight, continuity, accountability and protection of the Society's interests. It shall not treat itself as the owner or government of the elected Union.
  • The Elected Union/Executive Body shall manage the day-to-day affairs assigned to it by the Society's constitution and approved rules.
  • The Governing/Supervisory Body shall not interfere with the Election Commission's impartial conduct of an ongoing election except where required by the Society's valid constitution or applicable law.

22. No-Confidence / Removal After Election

An elected office-bearer shall not be removed merely on the personal decision of an individual member of the Governing/Supervisory Body.

  • Where the Society's constitution permits a no-confidence process, it shall be initiated only on documented grounds such as persistent non-performance, serious misconduct, misuse of Society resources, material violation of the Constitution/By-Laws or a serious conflict of interest.
  • The concerned office-bearer shall receive written notice of the allegations and a reasonable opportunity to respond.
  • Any final removal shall follow the procedure and voting authority provided by the Society's valid constitution/by-laws and applicable law.

23. Interpretation and Supremacy of Law

These Election By-Laws shall be interpreted consistently with applicable laws of Pakistan and the valid constitutional documents/by-laws of PGSHS Welfare Society.

  • Nothing in these By-Laws shall authorize an action contrary to mandatory law.
  • Where an ambiguity arises, the interpretation promoting fairness, transparency, equality, peace, accountability, integrity and the best interest of the Society shall be preferred, subject to the Society's constitution and applicable law.

24. Candidate Undertaking

I hereby confirm that I have read and understood the Election By-Laws and Code of Conduct of PGSHS Welfare Society. I undertake to provide true and genuine information/documents, comply with the election procedure, respect the Election Commission, avoid personal benefit or misuse of Society resources, and act in the best interest of the Society.

This undertaking is signed by hand and submitted along with the candidate's nomination papers at the Society office — it is not collected through this website.
